Poland
Residency route coverage
| Route family | Routes | Coverage |
|---|---|---|
| Investment | No routes recorded | No qualifying route as of 2026-08-23[1][13] Poland has no residence route granted for making an investment. The Act on Foreigners sets out every temporary residence permit by purpose, and the Office for Foreigners publishes the same catalogue; neither contains an investment category, and the grounds for permanent residence do not either. |
| Remote work | No routes recorded | No qualifying route as of 2026-08-24[1][12][13] Poland has no digital-nomad or remote-work route. Every Polish work permit is built around work performed in Poland, for an entity based there or a business conducted there; none turns on working remotely for an employer or clients abroad. The nearest instrument is the continuation of a Poland.Business Harbour national visa, shown here under work, which carries free access to the labour market but is open only to Belarusian nationals who already hold that visa. |
| Passive income | No routes recorded | No qualifying route as of 2026-08-23[1][13] Poland has no retirement, pensioner or passive-income route. The same two lists that answer the investment question contain no category for a retiree or for a person of independent means. A sufficient and stable income test does exist in Polish law, but only as a condition attached to another purpose. |
| Entrepreneur | Routes recorded as of 2026-08-23[1][9][15] One route. Poland has no startup, accelerator-endorsed or innovation-graded entrepreneur permit: the single instrument is the temporary residence permit for conducting business activity (art. 142), which serves both a sole trader registered in CEIDG and a foreigner working through an office in a company they formed or bought into. Family placement is deliberate: art. 142 ust. 3 (board member, general partner of a limited or limited joint-stock partnership, or commercial proxy) describes performing work, and could be argued into the work family, but it is a limb of one permit whose stated purpose is conducting business activity and it is recorded once, here. Poland.Business Harbour is not recorded as a route: it is a national visa programme under art. 60 ust. 1 pkt 23, not a residence permit; the residence continuation it feeds sits in art. 186 ust. 1 pkt 9 under 'other circumstances', which belongs to a later run. | |
| Work |
| Routes recorded as of 2026-08-24[1][12][18][21] |
| Study | Routes recorded as of 2026-08-24[1][14][21] Two routes, and the distance between them is the point. University study and doctoral schools sit in their own chapter (art. 144-150) with a defined term, a defined means test, free labour-market access and a 9-month post-study job-search permit behind it. School education and vocational training have no chapter at all: they are one item in the discretionary residual list (art. 187 pkt 1), capped at 1 year, carrying no free labour-market access and no post-study route, and the wojewoda MAY rather than MUST grant it. A reader comparing 'study routes' across countries should not read Poland's two as comparable instruments. Located and not documented as study: art. 186 ust. 1 pkt 3 lit. b lets a holder of another member state's EU long-term resident permit come to Poland to study or take vocational training – it is recorded once, in work, as pl-rezydent-dlugoterminowy-innego-panstwa-ue. Student mobility under art. 149b, which lets a student admitted in another member state study in Poland on notification for up to 360 days, is a mobility regime rather than a permit and is not recorded as a route. | |
| Family |
| Routes recorded as of 2026-08-24[1][11][21] Five routes, drawn on the statute's own instruments rather than on the Office for Foreigners' thirteen applicant categories: the permit for a family member of a Polish citizen (art. 158 and 158a), family reunification with a foreign sponsor (art. 159), the discretionary permit for a family member of an EU, EEA-EFTA, Swiss or UK Withdrawal Agreement national and for a person conducting family life within the meaning of the ECHR (art. 160), long-term mobility of a researcher's family member (art. 161b), and the family member of a holder of another member state's EU long-term resident permit (art. 186 ust. 1 pkt 4). Two boundaries are worth stating. A Polish citizen is NOT a qualifying sponsor under art. 159 – their family uses art. 158, which imposes no income, accommodation or waiting condition at all, while art. 159 imposes all three on an ordinary temporary permit holder. And an unmarried partner has no named route: they use art. 160 pkt 3's family-life ground, which is discretionary. Located and deliberately not documented: art. 161, which gives an AUTONOMOUS permit after 5 years on reunification permits or on divorce, separation or widowhood – a continuation of art. 159 rather than an entry route, and recorded in that route's note; and art. 186 ust. 1 pkt 1, a narrow ground for the family of a migrant worker or self-employed person within art. 19 of the European Social Charter, which duplicates art. 159's population for a small class of Charter states. |

Permanent residence
| Qualifying years | 5 as of 2026-04-07[1] Zezwolenie na pobyt rezydenta długoterminowego UE (EU long-term resident permit), art. 211 ust. 1: 5 years' legal and uninterrupted residence immediately before the application. This is Poland's general residence-duration route to indefinite status. The separate zezwolenie na pobyt stały (art. 195) is not a duration route: it is granted on enumerated grounds (Polish origin, Karta Polaka, marriage to a Polish citizen, refugee status and others), none of which is time-on-a-temporary-permit alone. |
|---|---|
| Language requirement | B1 as of 2026-04-07[1] Art. 211 ust. 1 pkt 3 and ust. 3: Polish at CEFR B1 or above, evidenced by an official certificate or by a Polish-medium school leaving certificate or degree. Not required of a foreigner under 16 at the date of application (ust. 4). |
| Integration requirement | No as of 2026-04-07[1] |
| Income requirement | 1 × social-assistance income criterion, single-person household per month as of 2026-04-07[1] Art. 211 ust. 1 pkt 1 with art. 140 ust. 2: a stable and regular source of income HIGHER than the social-assistance income criterion, for the applicant and each dependent family member. Art. 211 ust. 2 adds that the test must have been met over the 2 or 3 years of residence preceding the application, depending on the qualifying route. |

Citizenship
| Years to naturalisation | 3 as of 2026-08-23[3] Uznanie za obywatela polskiego, art. 30 ust. 1 pkt 1 of the Act of 2 April 2009 on Polish citizenship: 3 years' uninterrupted residence on a pobyt stały permit, an EU long-term resident permit or a permanent right of residence, plus a stable and regular source of income and legal title to a dwelling. Read with permanent_residency.eligibility_years, the shortest ordinary path from arrival is 5 years to the EU long-term resident permit and 3 years on it. Shorter recognition grounds exist for other situations (2 years for a spouse of 3 years' standing or a stateless person, 1 year for a pobyt stały permit obtained through Polish origin or a Karta Polaka), and a 10-year ground exists for those who hold indefinite status without meeting pkt 1. A separate, wholly discretionary grant by the President (art. 18) carries no residence condition at all. |
|---|---|
| of which on permanent residence | 3 as of 2026-08-23[3] All three years of art. 30 ust. 1 pkt 1 must be spent on pobyt stały, the EU long-term resident permit or a permanent right of residence; time on a temporary permit does not count. |
| Dual citizenship | allowed as of 2026-08-23[3] Art. 3 ust. 1: a Polish citizen who simultaneously holds another citizenship has the same rights and duties towards Poland as a person holding Polish citizenship only. Art. 3 ust. 2: such a person may not invoke the other citizenship, or rights arising from it, before Polish authorities. |
| Language requirement | B1 as of 2026-08-23[3] Art. 30 ust. 2: Polish at CEFR B1 or above, evidenced by an official certificate under art. 11a of the Act of 7 October 1999 on the Polish language, or by a Polish school leaving certificate or a Polish-medium school certificate obtained abroad. Minors recognised under ust. 1 pkt 4-5 are exempt. |
| Citizenship test required | No as of 2026-08-23[3] Art. 30 states the conditions for recognition exhaustively and names no civics or constitution test; the only knowledge condition is the B1 language evidence in ust. 2. Sourced absence on a closed enumeration. |
Tax
| Tax-residency day threshold | 183 as of 2026-08-23[16] Art. 3 ust. 1a pkt 2 of the PIT Act: more than 183 days on Polish territory in the tax year. The two limbs of ust. 1a are alternatives, not cumulative. |
|---|---|
| Other tax-residency triggers | centre of vital interests as of 2026-08-23[16] Art. 3 ust. 1a pkt 1: a centre of personal or economic interests (ośrodek interesów życiowych) in Poland. The Act names only this and the day count. |
| Headline income tax rate | 32% as of 2026-08-23[16] |
| Income tax structure | progressive as of 2026-08-23[16] |
| Net-wealth tax | No as of 2026-08-23[16][17] The Ministry of Finance's own catalogue of the taxes it administers (podatki.gov.pl) lists PIT, CIT, VAT, PCC, inheritance and gift tax, excise, tonnage tax, gaming tax, retail sales tax, the minerals extraction tax, the tax on certain financial institutions, the small-container alcohol tax, the sugar levy and local taxes; no recurring net-wealth tax appears. This rests on a portal catalogue rather than a statutory enumeration closed on its face, so it is a weaker sourced absence than contemplates. |
| Inheritance or estate tax | Yes as of 2026-08-23[7][17] Ustawa z dnia 28 lipca 1983 r. o podatku od spadków i darowizn, consolidated text Dz.U. 2026 poz. 478, recorded as in force in the Sejm ELI register. Rates and the close-family exemption were not researched – the tax block is deliberately thin. |

Changes
Recent changes
| 2025-06-01 | The Act of 20 March 2025 on the conditions for the admissibility of entrusting work to foreigners (Dz.U. 2025 poz. 621) entered into force and amended the Act on Foreigners. For the business-activity permit it replaced the statute that defines which employees count towards the two-employee alternative in art. 142 ust. 1 pkt 3 lit. a, and updated the terminology and cross-references in art. 142a. Affects: Temporary residence permit for the purpose of conducting business activity[1][20] |
|---|---|
| 2026-01-01 | The Act of 21 November 2025 amending the Act on Foreigners and certain other acts (Dz.U. 2025 poz. 1794) entered into force – a procedural reform of the Act, including a rewritten procedure and a six-month decision deadline for the EU long-term resident permit (new arts. 222c-222d) and the digitalisation of visa procedures. Affects: country-core[2] |
| 2025-06-01 | The Act of 20 March 2025 on the conditions for the admissibility of entrusting work to foreigners (Dz.U. 2025 poz. 621) entered into force and replaced the individual labour-market test – the starosta's opinion on the local labour market for a named vacancy – with a standing negative list of occupations, drawn up per powiat by the starosta, approved by the wojewoda and published in a national register (art. 31). The Act on Foreigners was amended in step: art. 114 ust. 1 pkt 3 and art. 127 pkt 2 now refuse a permit where the occupation is on that list. The same Act restated in one place which residence titles carry free access to the Polish labour market (art. 3 ust. 1). Affects: Temporary residence and work permit (single permit), Temporary residence permit for work in a profession requiring high qualifications (EU Blue Card)[1][21] |
| 2026-01-01 | The national minimum wage rose to PLN 4,806 a month (Rozporządzenie Rady Ministrów of 11 September 2025, Dz.U. 2025 poz. 1242), which is the salary floor for the single residence-and-work permit under art. 114 ust. 1 pkt 5 – payable in full regardless of working time. Affects: Temporary residence and work permit (single permit)[8] |
| 2026-02-10 | The President of GUS announced the average wage in the national economy for 2025 at PLN 8,903.56 a month (M.P. 2026 poz. 192), which moved the EU Blue Card salary threshold for applications filed in 2026 to PLN 160,264.08 gross a year, i.e. above PLN 13,355.34 gross a month. Affects: Temporary residence permit for work in a profession requiring high qualifications (EU Blue Card), Temporary residence permit for long-term mobility of an EU Blue Card holder[5][10] |

| on a date to be announced in a communique under art. 17 of the Act of 21 November 2025 (Dz.U. 2025 poz. 1794); no date is set in the instrument itself | A second, larger tranche of the same amending Act is held back to the same communique and rewrites how every temporary residence permit is applied for: new arts. 105-106a move filing into the Office for Foreigners' electronic Moduł Obsługi Spraw and drop the personal-appearance requirement, art. 112a ust. 2 pkt 1 is repealed so the 60-day clock no longer waits on that appearance, a new art. 104 ust. 1b names the competent wojewoda for family applications made from abroad under art. 159 ust. 1 and art. 160 pkt 1, 3, 4 and 6, and art. 144 ust. 1 pkt 1 lit. a – the certificate of admission to studies – is repealed in favour of the POL-on register check art. 148b already requires. The Office for Foreigners' procedure pages already describe electronic filing through the module, so the reader-facing position and the consolidated statutory text are out of step until the communique issues. Affects: country-core, Temporary residence and work permit (single permit), Temporary residence permit for the purpose of study, Temporary residence permit for the purpose of family reunification, Temporary residence permit for a family member of an EU, EEA-EFTA or Swiss national, and on account of conducting family life[1][2][12] |
