Residency route facts
Identity
| Official name (local) | Prechodný pobyt na účel podnikania as of 2026-08-24[3][5] The Act gives the permit one name and the two limbs of § 22 ods. 1 share it; both the Ministry of Foreign and European Affairs' catalogue and the Border and Aliens Police's own question set use this wording. The record carries the same value on both routes because the authority publishes no separate name for either limb. This route is the § 22 ods. 1 písm. b limb: koná alebo bude konať v mene obchodnej spoločnosti alebo družstva a nie je v pracovnoprávnom vzťahu. |
|---|---|
| Official name (English) | Temporary residence for the purpose of business as of 2026-08-24[3] Translation of the Slovak statutory name. Slovak is the sole language of the operative text; the Ministry of Foreign and European Affairs publishes this page under an English URL but with Slovak body text, so this is a translation rather than an official English name. |
| Legal basis | Zákon č. 404/2011 Z. z. o pobyte cudzincov a o zmene a doplnení niektorých zákonov, § 22 ods. 1 písm. b, read with § 32 (náležitosti žiadosti) and § 33 (rozhodovanie) as of 2026-08-24[2][3][5] |
| Instrument type | residence permit as of 2026-08-24[3] |
Who can apply
| Nationals not served by this route | EU as of 2026-08-24[3] |
|---|---|
| Minimum age | Not established from a qualifying source Not established. No age condition appears in the Border and Aliens Police document list for this permit, but that list is documentary rather than an enumeration of conditions. |
| Criminal-record condition | Yes as of 2026-08-24[5] § 32 ods. 2 písm. b): a document no older than 90 days confirming good character, being a criminal-record extract from the state of nationality and from every state where the applicant spent more than 90 days in any six consecutive months in the last three years. The extract must cover the whole territory of the issuing state or the police unit will not accept it. |
Permit terms
| Initial duration | up to 3 years as of 2026-08-24[3][5] § 22 ods. 2: granted for the expected duration of the business activity and for no longer than three years. The Act sets no floor, so the term actually granted is the police unit's assessment of the purpose. The Ministry of Foreign and European Affairs also records that there is no legal entitlement to a grant of temporary residence. |
|---|---|
| Renewable | Yes as of 2026-08-24[2][3] Renewal (obnovenie prechodného pobytu) is a distinct procedure with its own document set. The Ministry of Economy is asked for an opinion on renewal applications as well as first grants, and on renewal it looks at whether the applicant is trading in reality rather than only on paper, at tax compliance and at the number of employees. |
| Renewal duration | Not established from a qualifying source |
| Work rights | own activity only as of 2026-08-24[1][3] § 20 ods. 2: temporary residence is tied to a single purpose, and a third-country national who wants to carry on a different activity must file a fresh application. The permit therefore authorises the business activity it was granted for and nothing else. A holder may study during the stay (§ 20 ods. 3). |
Permanent residence and citizenship
| Counts toward permanent residence | Not established from a qualifying source Not established. Whether time on this permit counts towards EU long-term residence under § 52 could not be sourced, for the same reason permanent_residency.eligibility_years is unknown. Five-year permanent residence under § 43 is not a duration route and this permit is not a way into it. |

Requirements
| Minimum capital | 100 × subsistence minimum for one adult natural person one-off as of 2026-08-24[4][5] |
|---|---|
| Business plan required | Yes as of 2026-08-24[5] The July 2025 document list requires a business plan on the template published on the Ministry of Economy's website together with a document evidencing the feasibility and sustainability of the business activity, or alternatively a business plan for the realisation of an innovative project. The Ministry of Economy describes the same form as a 'simplified business plan' the applicant should be able to complete unaided, and says it assesses feasibility, sustainability and expected contribution such as job creation or activity in shortage occupations. The list groups the business plan under the same heading as the business-authorisation documents, which leaves it arguable whether the plan and the trade licence are cumulative or alternative; the reading taken here is that the plan is required. |
| Endorsement required | No as of 2026-08-24[2] No endorsement the applicant procures. The police unit itself asks the Ministry of Economy for an opinion on the economic contribution of the planned business, and that opinion is a sub-opinion of recommendatory character within the police unit's own administrative proceedings. The Act imposes no deadline on the Ministry for issuing it. Companies holding a certificate of significant investment are the exception and send their applications to the Ministry directly. |
| Innovation criterion | No as of 2026-08-24[5] Innovation is not a condition. A business plan for the realisation of an innovative project is an alternative form of the plan, and its only recorded consequence is on the business-funds test on the § 22 ods. 1 písm. b) limb, where it lowers the required balance from one hundred times the subsistence minimum to forty times. It changes nothing on the § 22 ods. 1 písm. a) limb. |
| Jobs to be created | Not applicable[2][5] No job-creation condition is attached to the grant. Expected job creation appears only as one of the things the Ministry of Economy weighs in its advisory opinion, and on renewal it looks at the number of employees – an assessment input, not a threshold. |
| Own means requirement | Not established from a qualifying source A separate personal financial-security condition exists and is distinct from the business funds: § 32 ods. 2 písm. c) with § 32 ods. 6 písm. a) requires the applicant to prove financial security of the STAY by a statement of the balance on a bank account in their own name, and § 32 ods. 7 requires the business funds to sit in a separate account opened for business purposes which may not be the same account. The Border and Aliens Police quantify the business-funds test and state no amount for the personal one, so the level of this condition is not established. Two further conditions have no field in this block: health insurance, and a medical certificate that the holder does not suffer from a disease endangering public health, both of which must be delivered to the police unit within 30 days of collecting the residence document, and secured accommodation under § 32 ods. 2 písm. e). |
Process
| Where to apply from | either as of 2026-08-24[3][5] |
|---|---|
| Statutory processing time | 90 days as of 2026-08-24[2][3][5] § 33 ods. 8: the police unit decides within 90 days. The Border and Aliens Police start the clock at receipt of a COMPLETE application, and where the application is lodged at a mission the mission has a further 30 days to process and forward it, so 90 days is not a clock from lodging. A 30-day period applies instead where the applicant represents or works for a significant foreign investor in Slovakia and is a national of an OECD member state. |
