Official name (English)Worker residence status as of 2024-06-17[7]
Translation. MIGRACIONES publishes no official English name for any calidad migratoria
Legal basisDecreto Legislativo 1350 art. 29.2 lit. h (as amended by Decreto Legislativo 1582); Reglamento aprobado por Decreto Supremo 007-2017-IN arts. 88, 88-A (application from abroad), 88-B (change of status in-country) and 88-C (extension), art. 88.3 lit. b as amended by Decreto Supremo 002-2021-IN; Decreto Legislativo 689, Ley para la contratación de trabajadores extranjeros as of 2023-11-14[1][2][4][8][9]
Arts. 88-A, 88-B and 88-C were incorporated into the Reglamento by DS 002-2021-IN and are the articles the current TUPA cites as base legal for the three procedures
Instrument typeresidence permit as of 2021-03-24[4][8][9]
A calidad migratoria evidenced by a carné de extranjería. On an application from abroad MIGRACIONES approves the calidad and notifies the Ministry of Foreign Affairs, which authorises the visa at the Peruvian consulate before entry

Who can apply

Who can apply
Nationals not served by this routeNot applicable
No supranational free-movement bloc of the kind this field records applies to Peru. Nationals of Andean Community and Mercosur states have their own treaty-based residence routes but are not excluded from this one
Minimum ageNot applicable as of 2023-11-14[1][8][9]
No minimum age condition appears in DL 1350 art. 29.2 lit. h, in Reglamento arts. 88 and 88-A, or in the published requirements. In practice the route runs through an employment contract approved by the labour authority, and Peruvian labour law sets its own minimum working age, which is not a condition of the calidad migratoria
Criminal-record conditionYes as of 2026-08-26[7][8][9]
The applicant files a certificate issued by the competent authority showing no judicial, criminal or police record in the country of origin and in any country of residence over the five years before arrival (Reglamento art. 88-A req. 4 and the parallel requirement in every other residence procedure), plus, where MIGRACIONES requires it, an Interpol Ficha de Canje (DL 1350 art. 26.2). Minors are exempt from the certificate on several procedures

Permit terms

Permit terms
Initial duration365 days as of 2023-11-14[1][8][9]
Reglamento art. 88.4: "El plazo de otorgamiento y de permanencia es de trescientos sesenta y cinco (365) días, prorrogables"; DL 1350 art. 29.2 lit. h states the same 365 days
How the initial term is setfixed
RenewableYes as of 2026-08-26[8][9]
Reglamento art. 88.5: the extension is granted for the same period. There is no stated ceiling on the number of extensions
Renewal duration365 days as of 2026-08-26[8][9]
Reglamento art. 88.5: "El trámite de prórroga se aplica por el mismo plazo otorgado"
Work rightsfull as of 2023-11-14[1][8][9]
DL 1350 art. 29.2 lit. h and Reglamento art. 88.1 allow lucrative activity, subordinate or independent, in the public or private sector, under a contract of employment, an administrative relationship or a services contract. The grant is nevertheless tied to the contract the calidad was approved on: Reglamento art. 88-C states that the holder "solo puede realizar las actividades que le permita su calidad migratoria", and a change of employer means a fresh contract approved by the labour authority. `full` records that both employed and self-employed work are open, not that the holder is free of the contract

Permanent residence and citizenship

Permanent residence and citizenship
Counts toward permanent residenceYes as of 2024-11-27[4][6][8]
Reglamento art. 65.4 (as amended by DS 002-2021-IN) lists the calidades whose holders may change to permanente — religioso, inversionista, trabajador, investigación, familiar de residente, consular, diplomático, oficial and familiar oficial — and this one is among them. DL 1350 art. 29.2 lit. o sets the condition: three years as a legal resident. The TUPA procedure is 'Cambio de Calidad Migratoria Permanente Residente'

Requirements

Requirements
Job offer requiredYes as of 2026-08-26[7][8][9]
Reglamento art. 88.3 lit. a and the TUPA requirement list: a contract in the public or private sector, approved by the labour authority, stating a term of one year or more. A contract with a probation period, or a term under one year, is evaluated as a trabajador temporal application instead (Reglamento art. 88-A lit. d)
Labour-market testNo as of 2026-08-26[2][3]
There is no labour-market test. DL 689 art. 7: the application carries a sworn statement that the worker is within the art. 4 percentage limits, and "El contrato se considerará aprobado a la presentación de la solicitud", without prejudice to an inspection visit the labour authority may order. What DL 689 imposes is a proportional ceiling per employer (recorded under process.quota), not a test of whether a national could fill the post
Qualification requirementdegree, equivalent experience as of 2026-08-26[2][3]
DL 689 art. 8 lit. c requires the contract-approval file to carry "El título profesional o los certificados correspondientes, debidamente legalizados por las autoridades competentes" — the professional qualification or the corresponding certificates. The statute does not define the certificates further, so both limbs are recorded. The condition sits in the labour-contract approval stage, not in the MIGRACIONES procedure, whose requirement list does not ask for a qualification
Employer sponsorshipYes as of 2026-08-26[8][9]
The employer is a party throughout: it obtains the contract approval, it must be active and habido before SUNAT, and its legal representative signs a sworn declaration filed with the migration application
Job-search routeNo as of 2023-11-14[1][8][9]
This is not a job-search route: the calidad is granted on an approved contract that already exists

Process

Process
Where to apply fromeither as of 2021-03-24[4][8][9]
Reglamento art. 88-A is the application made from abroad, with the visa authorised at the Peruvian consulate; art. 88-B is the change of calidad migratoria, which Reglamento art. 65.3 allows only from inside the country

30 días hábiles (working days) for both the application from abroad and the in-country change; the extension procedure runs on 5 working days. Negative administrative silence applies to all three, so no answer within the period is a refusal open to appeal

Quota
  • Quota exists: Yes as of 2026-08-26[2][3][8]
Peru does not limit how many work permits it issues. It limits each employer: foreign nationals may be at most 20% of a company's workforce and at most 30% of its payroll. Several categories are exempt from those limits, including people married to a Peruvian and people covered by a labour agreement between Peru and their own country.
Stages
    • Label: Approval of the employment contract by the labour authority (regional government), before the migration application — DL 689 arts. 2, 7 and 8; the approval certificate has indefinite validity, and the contract copy filed with MIGRACIONES must be no more than 30 calendar days old
    • Statutory clock: 3 days as of 2023-03-20[3][5]
gob.pe records the labour-contract approval as a 3-day positive-silence procedure. DL 689 art. 7 goes further: "El contrato se considerará aprobado a la presentación de la solicitud", subject to a later inspection visit. The procedure is run by the regional government of the workplace's region, so the fee varies by region and is not recorded here
    • Label: Migration application to MIGRACIONES — Reglamento art. 88-A (from abroad) or 88-B (change in-country)
    • Statutory clock: 30 days as of 2026-08-26[9]
      30 working days, negative silence

Physical presence

Physical presence
maximum consecutive absence183 days · to keep the permit as of 2021-03-24[4][8]
Reglamento art. 63 lit. a (as amended by DS 002-2021-IN): a holder of a residence calidad migratoria loses it by being absent from Peru, without an authorisation to stay abroad, for more than 183 consecutive days within a 365-day period counted from the first departure during the residence granted. An authorisation to stay abroad (Reglamento art. 67.2) suspends the count

Family inclusion

Family inclusion
Family members may be includedYes as of 2023-11-14[1][8][9]
Family members do not ride on this permit: they apply for the separate familiar de residente calidad migratoria (Reglamento art. 89), which is open to the migratory family unit of any foreign national holding regular residence. DL 1350 art. 38 defines that unit as the spouse or the partner in a unión de hecho under the Civil Code; the couple's minor child; the couple's unmarried adult child up to 28 while in technical or higher education; the couple's unmarried adult child unable to support themselves through proven physical or mental disability; the minor child of one spouse or partner; that child as an adult where the same disability applies; and an ascendant of the couple. 'parent' in eligible_relations carries that ascendant limb, which is wider than a parent (grandparent is not separately named and is not asserted here)
Eligible relationsspouse, unmarried partner, minor child, adult dependent child, parent, grandparent as of 2023-11-14[1][8]
DL 1350 art. 38 lit. a–g, as amended by DL 1582
Family may apply at the same timeNot established from a qualifying source as of 2026-08-26[8][9]
Neither the Reglamento nor the TUPA states whether a familiar de residente application may be filed together with the principal's, or only after the principal holds residence. Reglamento art. 89.1 requires a proven family link with a foreign national already resident, which points at 'after', but the instruments do not say so and it is not asserted here
Family members' work rightsfull as of 2023-11-14[1][4][8]
Reglamento art. 89.5: the familiar de residente calidad allows the holder to enter and stay and to carry out lucrative activity, employed or self-employed; DL 1350 art. 29.2 lit. k says the same
