Family-of-resident residence status
Residency route facts
Identity
| Official name (local) | Familiar de residente as of 2023-11-14[1][5][6] Statutory name of the calidad migratoria in DL 1350 art. 29.2 lit. k; Reglamento art. 89 is headed "Calidad migratoria Familiar Residente", and the TUPA runs four procedures under that heading — an application and a change of status, each in an adult version and a minor-child version |
|---|---|
| Official name (English) | Family-of-resident residence status as of 2024-06-17[3] Translation. MIGRACIONES publishes no official English name |
| Legal basis | Decreto Legislativo 1350 arts. 29.2 lit. k and 38 (both as amended by Decreto Legislativo 1582); Reglamento aprobado por Decreto Supremo 007-2017-IN arts. 89, 89-A (application from abroad), 89-B (change of status in-country) and 89-C (extension), incorporated by Decreto Supremo 002-2021-IN as of 2023-11-14[1][2][5][6] |
| Instrument type | residence permit as of 2021-03-24[2][5][6] A residence calidad migratoria evidenced by a carné de extranjería |
Who can apply
| Nationals not served by this route | Not applicable No supranational free-movement bloc of the kind this field records applies to Peru |
|---|---|
| Minimum age | Not applicable as of 2023-11-14[1][5][6] No minimum age condition applies: the route is expressly open to minor children, with its own procedures for them, and to adult children within the limits of DL 1350 art. 38 |
| Criminal-record condition | Yes as of 2026-08-26[3][5][6] The certificate of no judicial, criminal or police record is required, with an express exemption for minors and for people whose absolute incapacity prevents them expressing their will. The applicant files a certificate issued by the competent authority showing no judicial, criminal or police record in the country of origin and in any country of residence over the five years before arrival (Reglamento art. 88-A req. 4 and the parallel requirement in every other residence procedure), plus, where MIGRACIONES requires it, an Interpol Ficha de Canje (DL 1350 art. 26.2). Minors are exempt from the certificate on several procedures |
Permit terms
| Initial duration | Recorded at the source, but not reducible to a single value as of 2026-08-26[1][5][6] |
|---|---|
| How the initial term is set | matches the sponsor's permit |
| Renewable | Yes as of 2026-08-26[5][6] The TUPA carries extension procedures for adults and for minor children (Reglamento art. 89-C) |
| Work rights | full as of 2023-11-14[1][2][5] Reglamento art. 89.5: the calidad allows the holder to enter and remain and to carry out lucrative activity, employed or self-employed. DL 1350 art. 29.2 lit. k says the same. No extraordinary work permit and no labour-contract approval step is needed to work on it, which makes it the widest work grant available to a dependant in the Peruvian system |
Permanent residence and citizenship
| Counts toward permanent residence | Yes as of 2024-11-27[2][4][5][6] Reglamento art. 65.4 (as amended by DS 002-2021-IN) lists the calidades whose holders may change to permanente — religioso, inversionista, trabajador, investigación, familiar de residente, consular, diplomático, oficial and familiar oficial — and this one is among them. DL 1350 art. 29.2 lit. o sets the condition: three years as a legal resident. The TUPA procedure is 'Cambio de Calidad Migratoria Permanente Residente'. The TUPA carries a dedicated procedure for this route, "Cambio de Calidad Migratoria Permanente Residente (Familiar Residente)", separate from the one covering trabajador, inversionista, investigación and religioso |

Requirements
| Who can sponsor | citizen, permanent resident, temporary permit holder as of 2023-11-14[1][5][6] DL 1350 art. 29.2 lit. k and Reglamento art. 89.1: the sponsor is a Peruvian national or a foreign national resident in Peru, and art. 89.2 requires a foreign sponsor to be in a regular migratory situation. Peru's own word is "residente", which spans both the indefinite permanente calidad and the renewable one-year residence calidades — hence both `permanent_resident` and `temporary_permit_holder`. What it does not span is a holder of a *temporary* calidad migratoria (DL 1350 art. 29.1, entry "sin ánimo de residencia"), who cannot sponsor at all. The mapping is recorded here because the vocabulary's three statuses do not line up with Peru's two |
|---|---|
| Eligible relations | spouse, unmarried partner, minor child, adult dependent child, parent, grandparent as of 2023-11-14[1][5][6] |
| Sponsor income requirement | Not applicable as of 2023-11-14[1][5][6] No income, maintenance or accommodation condition on the sponsor appears in DL 1350 arts. 29.2 lit. k or 38, in Reglamento art. 89, or in any of the four TUPA requirement lists, which are exhaustive on their face. What MIGRACIONES may assess instead is the genuineness of the relationship: DL 1350 art. 29.2 lit. k gives it the power to evaluate the "solvencia/arraigo del vínculo matrimonial o unión de hecho" — the soundness or rootedness of the marriage or union — which is a discretionary test of the bond, not a financial threshold |
| Sponsor accommodation requirement | No as of 2023-11-14[1][5][6] No accommodation condition appears in the statute, the Reglamento or the TUPA requirement lists |
| Sponsor waiting period | Not applicable as of 2023-11-14[1][5][6] No qualifying period is imposed on the sponsor before the family member may apply. Neither DL 1350 art. 38, nor Reglamento art. 89, nor the TUPA requires the sponsoring resident to have held residence for any minimum time — only, where the sponsor is a foreign national, that the residence be current and regular (art. 89.2) |
| Pre-entry language test | No as of 2023-11-14[1][5][6] No language condition appears anywhere in the route. Peru imposes no language test on any residence calidad |

Process
| Where to apply from | either as of 2021-03-24[2][5][6] Reglamento art. 89-A from abroad; art. 89-B is the in-country change of calidad, which art. 65.3 allows only from inside Peru |
|---|---|
| Statutory processing time | 30 days as of 2026-08-26[3][6] 30 días hábiles (working days), negative administrative silence; the extension runs on 5 working days |
| Fees |
|
| Quota |
Physical presence
| maximum consecutive absence | 183 days · to keep the permit as of 2021-03-24[2][5] Reglamento art. 63 lit. a (as amended by DS 002-2021-IN). The second paragraph singles this route out: for the familiar de residente calidad held through a link with a Peruvian, the 183 consecutive days are counted within the residence period granted rather than within a 365-day window from the first departure |
|---|
Family inclusion
| Family members may be included | No as of 2023-11-14[1] |
|---|---|
| Eligible relations | Not applicable DL 1350 art. 38 bars a holder of this calidad from extending it to their own relatives |
| Family members' work rights | Not applicable No dependent route attaches to this one |
